This morning, Senate Majority Leader Mitch McConnell – immediately after consulting closely with the US Hemp Roundtable — has introduced report language that would call for the FDA to challenge formal “enforcement discretion” on the sale of hemp CBD merchandise.

As discussed far more fully last week, a main policy challenge facing the hemp CBD market has been FDA’s guidance that it is illegal for CBD to be introduced into interstate commerce as a meals additive or dietary supplement. Currently, the US Senate Appropriations Subcommittee on Agriculture will “mark up” language submitted by Senator McConnell that would call for the FDA to formally stand down on any enforcement of its troublesome anti-CBD guidance. Especially, the language (linked right here) would call for FDA to:
- Inside 90 days, offer Congress a report outlining its efforts to create an enforcement discretion policy on hemp CBD
- Inside 120 days, challenge its formal enforcement discretion policy on hemp CBD
- Preserve the enforcement discretion policy in impact till the agency has implemented its final regulatory procedure and
- Make sure that going forward, CBD suppliers would be in a position share security information by way of current FDA notification procedures to be totally compliant with federal law and policy.
